HEALTH and SAFETY (OFFENCES) ACT 2008

The new Health and Safety (Offences) Act 2008 that comes into full force on 16th January 2009 is likely to impact heavily on companies and individals who breach health and safety legislation.
Athough the new Act does not create any new offences it does, however,
- Raises the maximum fine which may be imposed in the lower courts to £20,000.00
- Makes imprisonment an option for more health and safety offences in both the lower and higher courts
- Makes certain offences, which can currently only be tried in the lower courts, triable in the lower or higher courts.
